Holder of copyright registration for a screenplay brought action against movie studio and others that produced allegedly infringing animated movie CARS, asserting claims for copyright infringement, unjust enrichment, and constructive trust. LP&S' filed a motion to dismiss on behalf of defendants, which was granted. The District Court, James Ware, J., held that: (1) the two works were not substantially similar, and (2) holder could not unjust enrichment and constructive trust claims based on alleged infringement.
