Trial Victory for “Diary of a Mad Black Woman”, Affirmed by Fifth Circuit

LP&S successfully defended Lions Gate Entertainment, Inc. in a lawsuit against it, Tyler Perry, and Perry's production company regarding alleged copyright infringement in Perry's Diary of a Mad Black Woman. Plaintiff Donna West alleged that Perry copied her play, Fantasy of a Black Woman, to create his movie and play, Diary of a Mad Black Woman. After a five day trial in the "plaintiff friendly" Eastern District of Texas and only about one hour of deliberation, the jury rejected plaintiff's $40-million claim and found no infringement. Plaintiff's motion for reconsideration was denied and the Fifth Circuit affirmed in August, 2010.
